This disclaimer applies to all HeroEngine and HeroCloud (HEL) legacy clients, including holders of binary licenses, source code licenses, and HeroCloud subscriptions. By continuing to engage with TGS Tech platforms and services, you acknowledge and accept the terms detailed below.

1. Security Warning and Authorized Platforms

TGS Tech currently operates exclusively through apexengine.com and tgs.tech. Any purchase, download, request for account information, login, or password request occurring outside of these domains is not authorized by or affiliated with TGS Tech.

Important Notice Regarding heroengine.com: TGS Tech does not currently operate heroengine.com. Any website, service, login portal, license offering, or password request appearing at heroengine.com or any associated subdomain is not authorized by TGS Tech. If you have been contacted through heroengine.com or directed to log in, purchase a license, or provide credentials through that domain, do not comply. TGS Tech will never request your current or previous password through any third party platform or unauthorized website.

2. Platform Status and License Types

HeroEngine is TGS Tech's legacy game engine technology, available under the following license types:

• Binary License: A compiled, executable version of HeroEngine delivered to the client for deployment and use.
• Source Code License: Full access to HeroEngine source code for client-side modification and deployment.
• HeroCloud Subscription: Cloud-based hosting and infrastructure supporting HeroEngine deployments, available as a monthly or annual subscription.

All license types are subject to the terms outlined in this disclaimer and the applicable licensing agreement on file with TGS Tech.

3. As-Is Acknowledgment

HeroEngine and HeroCloud are legacy platforms provided as-is. TGS Tech makes no guarantees regarding the availability, functionality, or performance of HEL beyond what is outlined in the applicable licensing agreement. Support is limited in scope. TGS Tech is working to improve HEL platform usability over time, including ongoing updates to the art pipeline. No guarantees are made regarding the timeline or scope of these efforts.

4. Access Rights and Benefits

HEL clients retain access rights as outlined in their applicable licensing agreement. Participants in the TGS Tech Founders Program also receive the following:

• Founders Program Access: Access to Founders-only Discord channels, including a private channel dedicated to HEL legacy client discussion.
• Platform Resources: Access to HeroEngine and HeroCloud platform resources as available.
• HEL Pricing Considerations: HEL participants are valued members of the TGS Tech Founders Program. Pricing for HEL is maintained at its established rate, with special pricing considerations available at TGS Tech's discretion based on factors including participation history, feedback contributions, and historical subscription tenure.
• News and Updates: Access to relevant HeroEngine Legacy and platform updates through official TGS Tech channels.

5. Refund and Cancellation

Refunds and cancellations for HEL licenses and HeroCloud subscriptions are governed by the TGS Tech Refund and Cancellation Policy. Clients are encouraged to review that policy for full details regarding eligibility, process, and terms.

6. Intellectual Property

All intellectual property associated with HeroEngine, HeroCloud, and related software, including source code, designs, tools, and trademarks, remains the sole property of TGS Tech. No license, subscription, or participation in the Founders Program grants ownership rights over any part of the platform or related materials.

All HeroEngine and HeroCloud development, including source code, architecture, tooling, and related technical documentation, has been conducted exclusively within the United States by TGS Tech employees. No offshore contractors or third party developers have been engaged in the development of HeroEngine or HeroCloud. These materials constitute proprietary trade secrets of TGS Tech and are protected under the Defend Trade Secrets Act and applicable state trade secret laws.

• Feedback Contributions: Any feedback or suggestions provided by HEL clients are considered voluntary and do not grant ownership rights or entitlements to compensation.

7. Limitation of Liability

As a legacy platform provided as-is, HEL clients acknowledge the following limitations:

• No Guarantees: TGS Tech makes no guarantees regarding the availability, functionality, or performance of HEL beyond what is outlined in the applicable licensing agreement.
• Potential Issues: Clients may encounter bugs, incomplete features, or performance issues consistent with legacy platform operation. TGS Tech is not liable for disruptions, data loss, or delays resulting from these issues.
• Third-Party Dependencies: HEL relies on third-party tools, integrations, and hosting services. TGS Tech is not responsible for disruptions caused by third-party providers.
• Unauthorized Activity: TGS Tech is not responsible for any damages, losses, or disruptions arising from unauthorized use of the HeroEngine name, trademark, or associated domains by third parties.

8. Support and Communication

TGS Tech is committed to transparency and will provide relevant updates to HEL clients through official channels, including the Apex Engine website, newsletters, and private Founders Program communication channels. Support for HEL is limited in scope and provided at TGS Tech's discretion in accordance with the applicable licensing agreement.

9. Good Faith Efforts

TGS Tech will make good faith efforts to address issues, incorporate feedback, and resolve challenges as they arise within the scope of limited legacy support. For disruptions caused by natural disasters, third-party failures, or emergencies, TGS Tech will make every reasonable effort to restore services and keep clients informed.

By continuing to engage with HeroEngine, HeroCloud, or any associated TGS Tech platform or service, you acknowledge and accept the terms of this HeroEngine Legacy Disclaimer.
