Development Disclaimer for Apex Engine

Apex Engine is an advanced platform under active development by TGS Tech. This disclaimer outlines the current status of the platform, access rights for early supporters, and expectations for participants in the Founders Program and Pilot Program. By engaging with Apex Engine, you acknowledge and accept the terms detailed below.


1. Platform Status

Apex Engine is currently in active development and is not available to the public at this time. The platform is undergoing rigorous design, development, testing, and refinement to meet the highest standards of functionality and quality. It is not yet a full-featured product, and access to the MVPs will be issued and remain restricted to participants in the Founders Program and invited members of the Pilot Program until further notice.

Once the minimally viable product (MVP) is released, availability will be limited and offered on a first-come, first-served basis. Entry into the Pilot Program and Founders Program guarantees early access, but this will be done in stages to ensure a smooth rollout and optimal user experience.

While participants in the Pilot Program and Founders Program will receive early access as part of their benefits, TGS Tech cannot guarantee specific timelines for when access will be granted. Access to the MVP and subsequent stages will be prioritized based on program enrollment and readiness.


2. Access Rights for Founders Program and Pilot Program Participants

Participants in the Founders Program and Pilot Program enjoy exclusive access rights as part of their early support for Apex Engine’s development. These rights are designed to keep participants informed, engaged, and involved in shaping the platform while maintaining limited availability to ensure quality and manageability.

Access Rights Include:

  • Limited Access:
    Access to the Apex Engine MVPs will be restricted to Founders Program members and invited Pilot Program participants. Availability is limited and will be issued in stages to ensure a controlled rollout.
  • News and Updates:
    Exclusive access to behind-the-scenes news, development updates, and insights shared directly with Founders and Pilot Program participants to keep them informed of progress.
  • Development Channels:
    Access to private communication channels, such as Founder-only Discord channels, where participants can engage with the development team, share feedback, and receive regular updates.
  • Exclusive Previews:
    Early previews of new features, tools, and updates as they are being developed, allowing participants to provide input and gain insight into the platform’s direction.
  • Special Discounts:
    Founders Program participants receive special discounts for future subscriptions, including Apex Engine Cloud and other services.

3. Limitations of Liability

As a developmental platform, participants acknowledge the following limitations:

  • No Guarantees:
    TGS Tech makes no guarantees regarding the availability, functionality, or performance of Apex Engine during its development phase.
  • Potential Issues:
    Participants may encounter bugs, incomplete features, or performance issues. TGS Tech is not liable for disruptions, data loss, or delays resulting from these issues.
  • Third-Party Dependencies:
    Apex Engine relies on third-party tools, integrations, and hosting services (e.g., AWS, Azure). TGS Tech is not responsible for disruptions caused by third-party providers.

4. Development Timeline

The development and release timeline for Apex Engine is subject to change. Projected dates for beta testing, feature rollouts, or full product releases are estimates only and may be adjusted based on:

  • Testing outcomes.
  • Resource availability.
  • Customer feedback.
  • Market conditions.

TGS Tech provides a public Development Roadmap to outline major goals and milestones. As we approach the MVP release, detailed milestones and changelogs will be added to give participants greater visibility into the platform's progress.


5. Refund and Credit Request Process

Refunds and credits are managed according to our Refund & Cancellation Policy. Customers are encouraged to review this policy for information regarding eligibility, process, and terms.


6. Intellectual Property

All intellectual property associated with Apex Engine, including but not limited to source code, designs, and tools, remains the exclusive property of TGS Tech.

  • Feedback Contributions:
    Participants may provide feedback or suggestions during the development process but waive any claims to ownership, royalties, or compensation related to these contributions.

7. Communication and Updates

TGS Tech is committed to transparency and will provide regular updates on Apex Engine’s progress, including:

  • Official Channels:
    Updates via the Apex Engine website, newsletters, and development roadmaps.
  • Private Channels:
    Exclusive communication channels, such as Discord, for Founders and Pilot Program participants to interact with the team and share feedback.

8. Good Faith Efforts

TGS Tech is dedicated to delivering a high-quality platform and will make good faith efforts to address issues, incorporate feedback, and resolve challenges as they arise. However, as the platform is still in development, certain features or issues may take time to address, and some functionalities may be deferred to future updates.
