Crowdfunding Support and Patreon Disclaimer

The TGS Tech Founders Program and Patreon Support Program are crowdfunding initiatives designed to support the development of Apex Engine, HeroEngine, and HeroCloud by TGS Tech. By participating in these programs, you acknowledge the terms outlined below, which ensure transparency and protect both you and TGS Tech throughout the process.

1. Nature of Contributions

What You Are Supporting: Your contribution helps fund the research, development, testing, and refinement of Apex Engine, HeroEngine, and HeroCloud. While exclusive benefits are provided as described, contributions are not a guarantee of specific outcomes or timelines.

  • Contributions through the Founders Program or Patreon are voluntary and intended to support the ongoing development of Apex Engine.
  • These contributions do not constitute a purchase of a completed product, investment, or equity in TGS Tech or any of our platforms or software including Apex Engine, HeroEngine, HEL or any future services.

2. Benefits and Rewards

  • Supporters will receive benefits such as:
    • Early access to Apex Engine Lite (MVP).
    • Founder-only discounts on future subscriptions.
    • Exclusive access to news, updates, and private channels (e.g., Discord).
    • Recognition in select project materials (where applicable).
  • These benefits are perks of participation and do not represent financial returns or ownership.

 

Availability and Limitations:

  • Access to MVPs and other features will be limited and provided on a first-come, first-served basis.
  • Benefits are subject to change or adjustment as the development progresses to meet technical and operational requirements.

3. No Refund Policy

  • Non-Refundable Contributions:
    Contributions to the Founders Program or Patreon are non-refundable, except where explicitly stated by TGS Tech.
  • Development Delays or Changes:
    Refunds will not be issued for delays, feature adjustments, or changes to the development roadmap.

4. Development Process and Limitations

  • Active Development:
    Apex Engine is currently in development, and features, functionality, and timelines are subject to change.
  • Phased Access:
    Early access to MVPs, tools, and features will be provided in stages and is not guaranteed at a specific date.
  • Limited Availability:
    Access is restricted to eligible Founders Program participants and invited members based on development readiness and operational capacity.

 

TGS Tech’s Commitment:

TGS Tech will make good faith efforts to deliver benefits, maintain communication, and address issues promptly. However, unforeseen challenges may impact timelines or functionality.

5. Intellectual Property

  • Ownership:
    All intellectual property associated with Apex Engine, HeroEngine, HeroCloud, HEL and other related software, including its features, tools, and source code, remains the sole property of TGS Tech.
  • Feedback Contributions:
    Any feedback or suggestions provided by supporters are considered voluntary and do not grant ownership rights or entitlements to compensation.

6. Limitation of Liability

  • Development Challenges:
    TGS Tech is not responsible for delays, changes, or interruptions caused by:
    • Unforeseen technical or operational challenges.
    • External factors such as third-party service disruptions or natural disasters.
  • Program Adjustments:
    TGS Tech reserves the right to modify, postpone, or cancel certain benefits or features as needed to align with development goals.

7. Communication and Updates

  • Regular updates will be provided through the Apex Engine website, official community channels, and other TGS Tech platforms, including private communication channels for Founders and Patreon supporters.
  • While TGS Tech aims for transparency, all updates are subject to change based on evolving development needs.

8. Acceptance of Terms

By participating in the Founders Program or Patreon Support Program, you acknowledge that your contributions are voluntary and governed by this disclaimer. You also agree to the limitations and conditions of your participation in any TGS Tech platform or service, current or future.
