Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") governs the use of all TGS Tech platforms, services, software, and downloadable content, including Apex Engine Cloud, Apex Engine Lite, HeroCloud, HeroEngine, Apex Connect, TGS Tech managed forums, and any current or future TGS Tech platform or service ("Services"). By accessing or using any TGS Tech Service, you agree to comply with this AUP. Violations may result in suspension or termination of access.

1. Permitted Use

TGS Tech Services are provided for lawful, authorized purposes in accordance with your applicable subscription or license agreement. Permitted use includes:

  • Developing, testing, and deploying applications and projects using Apex Engine, HeroEngine, or HeroCloud strictly in accordance with your license terms and for the specific title or project named in your license agreement.
  • Accessing and participating in Apex Connect and TGS Tech managed forums for community engagement, feedback, and collaboration.
  • Downloading and using TGS Tech software and resources for purposes explicitly authorized under your license or subscription agreement.

2. Prohibited Use

The following activities are strictly prohibited across all TGS Tech platforms, services, and downloadable software:

 

Unauthorized Access and Security Violations:

  • Attempting to gain unauthorized access to any TGS Tech platform, service, account, or system.
  • Exploiting vulnerabilities, bypassing authentication, or circumventing security measures.
  • Introducing malware, viruses, ransomware, or other malicious code into any TGS Tech platform or service.
  • Conducting unauthorized penetration testing or security scanning of TGS Tech infrastructure.

 

Resource Abuse:

  • Using TGS Tech platforms or services for cryptocurrency mining or any other unauthorized resource intensive activity.
  • Consuming excessive platform resources in a manner that degrades service performance for other users.
  • Running automated scripts, bots, or processes that place unreasonable load on TGS Tech infrastructure without prior written authorization.

 

Data Abuse:

  • Scraping, harvesting, or automated collection of data from any TGS Tech platform, service, or community without prior written authorization.
  • Data mining user information, community content, or platform data for commercial or unauthorized purposes.
  • Collecting, storing, or processing personal data of other users without their explicit consent and in violation of applicable privacy laws.

 

Intellectual Property Violations:

  • Reverse engineering, decompiling, disassembling, or attempting to derive source code from any TGS Tech software or platform beyond what is explicitly permitted under your license agreement.
  • Reselling, sublicensing, redistributing, or transferring access to any TGS Tech platform or service without prior written authorization from TGS Tech.
  • Reproducing, copying, or distributing TGS Tech software, tools, documentation, or proprietary content without prior written permission.
  • Using TGS Tech trademarks, including Apex Engine, AE, HeroEngine, and HeroCloud, without prior written authorization.

 

API Abuse:

  • Using TGS Tech APIs in ways that exceed documented rate limits or authorized use cases.
  • Accessing TGS Tech APIs without authorization or using API credentials belonging to another user or account.
  • Using TGS Tech APIs to build competing products or services without prior written authorization.

 

Unauthorized Distribution and Access:

  • Selling, transferring, gifting, or otherwise providing TGS Tech platform access or subscription benefits to unauthorized third parties.
  • Advertising, marketing, or offering TGS Tech platform access, licenses, or subscriptions for sale without prior written authorization from TGS Tech.
  • Creating, operating, or maintaining any public facing platform, portal, service, or website that offers access to TGS Tech platforms or services without prior written authorization.
  • Collecting fees, payments, or any form of compensation in exchange for access to any TGS Tech platform or service without prior written authorization from TGS Tech.

 

Unlawful and Harmful Activities:

  • Using TGS Tech Services for any illegal purpose or in violation of applicable local, national, or international laws.
  • Uploading, transmitting, or distributing illegal, harmful, explicit, or infringing content through any TGS Tech platform or service.
  • Impersonating TGS Tech, its staff, or other users on any platform or service.
  • Using TGS Tech Services to facilitate fraud, phishing, identity theft, or other deceptive activities.

 

Community and Platform Misuse:

  • Harassing, threatening, or abusing other users on Apex Connect, TGS Tech managed forums, or any other TGS Tech community platform.
  • Spamming, flooding, or disrupting community channels with irrelevant or excessive content.
  • Coordinating efforts to manipulate community ratings, votes, or feedback systems.

3. HeroEngine and HeroCloud License Restrictions

All HeroEngine licenses, including binary licenses, source code licenses, and open licenses, are subject to the following restrictions in addition to the general prohibitions outlined in Section 2.

 

Per Title Licensing:

All HeroEngine licenses are issued on a per title basis and are valid solely for the specific project or title named in the applicable license agreement. Use of a HeroEngine license across multiple titles, projects, or applications requires a separate license agreement for each. No license grants broad or general use rights beyond the specific title for which it was issued.

 

Open License Restrictions:

Open licenses issued by TGS Tech are granted exclusively for internal testing and training purposes. Open licenses do not grant the right to deploy, distribute, sell, or commercially release any title, product, or service built using HeroEngine. Any commercial use under an open license requires a separate written agreement with TGS Tech.

 

Non-Transferability:

All valid HeroEngine licenses are issued exclusively by TGS Tech or its predecessor entities. TGS Tech is the sole authorized issuer of HeroEngine licenses. Any license, access, subscription, or distribution of HeroEngine offered by any party other than TGS Tech is unauthorized and invalid. Prohibited Activities for All License Holders:

  • Selling, sublicensing, or distributing access to HeroEngine or HeroCloud to third parties.
  • Operating a public facing platform, portal, or service using HeroEngine without prior written authorization from TGS Tech.
  • Collecting fees, subscriptions, or payments from third parties in exchange for HeroEngine or HeroCloud access.
  • Using the HeroEngine trademark, name, associated domains, or branding without prior written authorization from TGS Tech.
  • Representing to third parties that you hold any rights to HeroEngine beyond those explicitly granted in your license agreement.

 

HeroCloud Specific Restrictions:

  • HeroCloud is a legacy platform provided as-is. HeroCloud subscriptions are issued to the subscribing entity only and may not be transferred, shared, or assigned without prior written authorization from TGS Tech.
  • HeroCloud resources may not be used for purposes unrelated to authorized HeroEngine deployments.

4. Reporting Violations

If you become aware of any activity that violates this AUP, please report it to TGS Tech immediately:

Reports will be handled confidentially. Filing false or malicious reports is itself a violation of this AUP.

5. Enforcement

TGS Tech reserves the right to investigate suspected violations of this AUP. Upon confirmation of a violation, TGS Tech may take any of the following actions at its discretion:

  • Issue a formal warning.
  • Temporarily suspend access to any TGS Tech platform or service.
  • Permanently terminate access to any TGS Tech platform or service.
  • Remove or disable content that violates this AUP.
  • Report violations to appropriate legal authorities where warranted.
  • Pursue civil or criminal remedies available under applicable law.

6. Limitation of Liability

TGS Tech is not liable for damages resulting from violations of this AUP by users or third parties. Users who violate this AUP are solely responsible for any resulting damages, losses, or legal consequences.

7. Governing Law

This Acceptable Use Policy is governed by the laws of the State of Maryland and Washington, DC. Any disputes arising under this policy will be resolved in the courts of these jurisdictions.

8. Modifications

TGS Tech reserves the right to update this AUP at any time. Changes will be communicated through the Apex Engine website, official community channels, and other TGS Tech platforms. Continued use of any TGS Tech Service following notification of changes constitutes acceptance of the updated policy.
